According to Article 47 Par. 1 titled “Agreement on Jurisdiction and Limitations” of the Turkish International Private and Civil Procedure Law numbered 5718, “Article 47- (1) Except in cases where the jurisdiction of a court is determined according to exclusive jurisdiction of specific court, the parties may agree on jurisdiction of a court of foreign state in a dispute which contains element of foreignness and arises from liability relations. The agreement is valid only when it is proven by a written evidence. The competent Turkish court shall have jurisdiction only if the foreign court deems itself as unauthorized or there is not any objection to jurisdiction over the case before Turkish courts.”
